These Terms of Service ("Terms") are a contract between you and C.Essentials Ltd, trading as Lustryx (Company No. 16001166, registered in England & Wales) ("Lustryx", "we", "us"). By creating an account, browsing, buying, or selling on Lustryx, you agree to these Terms, our Privacy Policy, and — where relevant to you — our Seller Agreement, Returns & Refunds Policy, Acceptable Use Policy, and Age Verification Policy, each of which forms part of this agreement. If you don't agree to all of them, please don't use Lustryx.
You must be at least 18 years old to register a buyer or seller account on Lustryx, and you confirm this (by date of birth and/or a card-verification check) as part of registration. Parts of the site display age-restricted categories, which are only shown to signed-in, age-confirmed accounts. See our Age Verification Policy for exactly how this works. You must also provide accurate registration information, keep your login details confidential, and notify us promptly at info@lustryx.com if you suspect unauthorised access to your account. You're responsible for activity that happens under your account.
Lustryx is a marketplace — we provide the platform, listing tools, payment infrastructure, and age-verification gate that let independent sellers list pre-owned and other physical products for sale to buyers. When you buy an item, your contract of sale is with the seller, not with Lustryx. We are not the manufacturer, owner, or seller of any listed product (unless a listing explicitly says otherwise), and we don't inspect every item before it's listed or shipped. Sellers are solely responsible for the accuracy of their listings, including condition grading, and for fulfilling orders. Our role is to provide the marketplace, process payment through Stripe, take a platform fee on completed sales, and provide the buyer-protection measures described in our Returns & Refunds Policy.
Buying on Lustryx is free; we charge sellers a platform fee, deducted automatically from the sale price at the point of payment, before the remaining balance is paid out to the seller's connected Stripe account. The applicable fee is shown to sellers before a sale completes. All payments are processed by Stripe — see our Privacy Policy for what that involves. Both buyers and sellers who self-declare their age (rather than having it verified by a supported login provider) must also complete a one-off £1 card-verification charge, which is automatically credited in full towards that account's first order.
Sellers may only list items that comply with our Acceptable Use Policy, which sets out prohibited and restricted items and conduct. We may remove any listing, suspend, or terminate any account at our discretion where we reasonably believe these Terms, the Acceptable Use Policy, or the law have been breached.
Your rights to cancel an order, return an item, or raise a dispute about an order are set out in our Returns & Refunds Policy, which forms part of these Terms.
You agree not to: use Lustryx for any unlawful purpose; impersonate another person or misrepresent your age or identity; attempt to circumvent our age-verification gate; interfere with or disrupt the site's security or normal operation; scrape, harvest, or misuse other users' data; or use the platform to sell or buy anything prohibited under our Acceptable Use Policy.
The Lustryx name, logo, and site design belong to C.Essentials Ltd. When you post a listing, you keep ownership of your content (photos, descriptions) but grant us a licence to host, display, and reproduce it on Lustryx and in our marketing, for as long as reasonably necessary to operate the marketplace. You confirm you have the right to grant us that licence — for example, that listing photos are your own and don't infringe anyone else's copyright or trade mark.
We provide Lustryx on an "as is" and "as available" basis. While we take reasonable steps to keep the platform secure and available, we don't guarantee it will be uninterrupted, error-free, or entirely secure. We are not responsible for the quality, safety, legality, or accuracy of listings created by sellers — that responsibility sits with the seller, subject to your rights under the Returns & Refunds Policy and applicable consumer law. To the fullest extent permitted by law, our liability to you for losses arising from your use of Lustryx is limited to the amount you paid us in platform fees (for sellers) or the value of the relevant order (for buyers) in the 12 months before the claim arose. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation.
You may close your account at any time by contacting us. We may suspend or terminate your account, immediately and without notice, if we reasonably believe you've breached these Terms, the Acceptable Use Policy, or the law, or if we're required to do so by our payment processor or a regulator. Where reasonably possible we'll tell you why. Some obligations — including payment, dispute-resolution, and liability provisions — survive account closure.
We may update these Terms from time to time, for example to reflect a new feature or a change in the law. We'll update the "Last updated" date above when we do, and where a change is significant we'll take reasonable steps to bring it to your attention (such as an email or an on-site notice) before it takes effect.
These Terms are governed by the law of England & Wales. If a dispute can't be resolved directly with us, the courts of England & Wales will have exclusive jurisdiction — except that if you're a consumer living elsewhere in the UK, mandatory local consumer-protection law may still apply and you may also be able to bring proceedings in your local courts.
